Terms of Service

1. Scope

These Terms of Service govern your use of the WineBiz Network platform (winebiz.net), operated by Roland Hahn (WineBiz Network), Austria. By registering or using our services, you agree to these terms.

2. Platform Description

WineBiz Network is a B2B platform connecting wine importers with wineries through structured Wine Tenders. Importers create sourcing briefs, wineries submit their wines to matching tender categories. The platform facilitates discovery and initial connection – all commercial agreements are made directly between the parties.

3. Registration

• You must provide accurate and complete information during registration
• One account per person or company – duplicate accounts may be suspended
• You are responsible for maintaining the confidentiality of your login credentials
• You must be authorized to represent your company when registering a business account

4. Importer Accounts

Importer accounts are free of charge. Importers can browse tender categories, express interest, create sourcing briefs, and receive matched winery submissions at no cost. Importer identities remain confidential throughout the tender process.

5. Winery Accounts & Entry Fees

• Wineries pay an entry fee per wine submission: EUR 75–95 depending on volume (1–2 wines: EUR 95, 3–5 wines: EUR 85, 6+ wines: EUR 75)
• Entry fees are non-refundable once a submission has been processed
• Fees are charged per tender participation, not as a subscription
• Payment is processed securely via Stripe
• Entry fees cover submission processing, compliance tasting coordination, and importer matching

6. Compliance Tasting

Submitted wines may undergo a compliance tasting to verify quality and category fit. WineBiz Network coordinates the tasting process but does not guarantee placement on any importer shortlist. The compliance tasting is an evaluation, not a competition or award.

7. Intellectual Property

All content on the WineBiz Network platform (design, text, logos, software) is owned by WineBiz Network and protected by applicable intellectual property laws. Users retain ownership of their submitted content (wine descriptions, images, company profiles) but grant WineBiz Network a license to display this content on the platform.

8. Prohibited Conduct

• Providing false or misleading information about your wines or company
• Attempting to contact importers outside the platform to circumvent the tender process
• Scraping, crawling, or automated data extraction from the platform
• Uploading malicious files or attempting to compromise platform security
• Using the platform for any purpose other than legitimate B2B wine trade

9. Limitation of Liability

WineBiz Network facilitates connections between wineries and importers but is not a party to any resulting commercial agreements. We do not guarantee business outcomes, import volumes, or successful transactions. Our liability is limited to the amount of fees paid by the user in the 12 months preceding any claim.

10. Termination

Either party may terminate the account at any time. WineBiz Network reserves the right to suspend or terminate accounts that violate these terms. Upon termination, access to the platform ceases, but data retention follows our Privacy Policy.

11. Governing Law

These terms are governed by Austrian law. Any disputes shall be resolved by the competent courts in Austria. For EU consumers, mandatory consumer protection laws of your country of residence may also apply.

12. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email to registered users. Continued use of the platform after notification constitutes acceptance of the updated terms.
